GENERAL
By registering and agreeing to the Terms & Conditions of T.H.A Nationwide, you agree to all of the following, as well as any further conditions contained in individual website pages. It is advisable to read all the Terms & Conditions before you place a bid.
 
T.H.A Nationwide reserve the right to suspend or terminate a bidder’s participation in a sale or any future sales as a result of any of the following:
       Attempts to manipulate the sale process
       Fraudulent activity
       Bidding on behalf of another bidder
       Use of any device, software or instruction to interfere with the T.H.A Nationwide website
       Refusal to pay outstanding amounts
 
T.H.A Nationwide will take all reasonable steps to process your bid, however we are not liable for failed bids as a result of technical error or any other problem.  
 
T.H.A Nationwide reserves the right to withdraw lots.
 
REGISTRATION
When you register you must not provide false or misleading information.
You agree that by bidding you have entered into a legal agreement to purchase.
You are responsible for the security of your username and password. Unauthorised usage will not negate your liability. If you think that someone who is not authorised by you is bidding on your behalf, you need to notify us immediately.
You agree to receive emails from us in notification of bids, winning bids, invoices, and other promotional material.
 
SALE CONDITIONS
 
By bidding you have agreed to all Terms & Conditions contained within this site. Familiarise yourself with any additional conditions relevant to particular sales.
Be certain of your bid as it cannot be cancelled once it is processed in our system. T.H.A Nationwide are not under any circumstances obliged to waive, or accept a request to waive a bid
When you are the successful bidder, you are libel to pay the winning bid plus the Buyers Premium
All assets are sold GST inclusive..
All assets have a reserve price unless otherwise stated.
All online bids, fees and charges are in $AUD
 
BIDDING
The tender closes at the nominated time, and bids must be submitted before that time.
 
The winning bidder will be notified by email, however even if you do not receive the notification of a winning bid, you are still deemed to be the winning bidder and therefore responsible for all due payments.
 
 
DEPOSIT
A requirement of registration at all T.H.A Nationwide online tenders or online auctions is pre- authorisation on your credit card for the deposit amount should you be the successful purchaser.  
 
Purchases under $10,000.00 – pre-authorisation of $500.00 and a 2% credit card fee. 
Purchases over $10,001.00 - pre-authorisation of $1,000.00 and a 2% credit card fee.
 
Please note these amounts will remain unavailable to use on your credit card until the pre-authorisation lapses, usually within 7 days, irrespective of whether you were the successful bidder.  This timeframe is out of our control and is determined by the credit card facilitators.
 
 PAYMENT
Payment in full must be received within two working days of notification that you are the successful purchaser.  Notification will be by email and non-delivery of the email will not cancel the sale.  Payment can be made in the following ways:      
 
Cash at point of collection of the goods.      
Direct Deposit of cleared funds into our nominated account.      
Credit Card Visa or Mastercard only -a 2%  fee applies 
 
Failure to comply with these payment conditions may result in all or any of the following:
  • If the outstanding amount is not approved on your credit card, T.H.A Nationwide will deduct any part of the invoice total in part payment only. We will continue to process payments until all outstanding monies are paid.
  • Reselling of auction item with all costs involved (including shortfalls) to be paid by you.
  TITLE
Property in and title to any vehicles sold does not pass to the person to whom they are sold until the whole of the purchase monies for the goods has been paid in full. Property in and title to the goods shall remain solely with the vendor until payment in full has been made and the funds are clear.
 
Risk for the vehicle passes to the buyer once it has been collected from our premises
 
DAMAGES
The purchaser indemnifies T.H.A Nationwide for any loss, damage or expense incurred in recovering, re-taking possession of or re-sale of any vehicle. T.H.A Nationwide may exercise its rights at law or in equity to trace the proceeds of any dealing by the purchaser.
 
NON-COMPLETION
Upon any purchaser failing to comply with any of the above conditions any money deposited in full or part payment or the Security Deposit shall be absolutely forfeited and all Lots uncollected may be resold and the deficiency (if any) on such resale, together with all costs and charges consequent upon such resale, shall be made

 EXCLUSION OF WARRANTIES AND LIABILITY
T.HA. Nationwide will not be responsible for any damage to property or injury to persons incurred during the removal of Lots purchased. 

You accept that all Lots are offered for sale 'as is, where is' with all faults (if any). To the full extent permitted by law and notwithstanding the contents of or any description given on the Online Sales System or other materials issued by T.H.A Nationwide in relation to a Lot, no express or implied condition, warranty or guarantee is made or given in relation to that Lot as to its condition, quality, fitness for purpose, merchantability or compliance with description. Without in any way limiting the foregoing, any description of a Lot described as including air bags or anti-lock braking system (ABS) does not indicate any warranty or representation that such air bags or ABS are fitted, complete, functioning or fit for the purpose for which they were designed.

You accept that the information provided describing the Lots included on this website may not always be reliable, accurate or complete. You are responsible for independently verifying any information which is important to your purchasing decision before submitting a "BID" request. 

You are not entitled to cancel any purchase transaction on the basis that the goods were not accurately described. We specifically exclude any implied warranty or conditions that we can lawfully exclude. 

All Lots shall be at the purchaser's risk from the end of the Auction Period and neither the Vendor nor T.H.A Nationwide shall be accountable for any deficiency, damage or loss which may arise thereafter. 

To the full extent permitted by law, neither the Vendor nor T.H.A  Nationwide will be liable for any loss, damage, cost or expense suffered or incurred by a purchaser arising out of the sale and purchase of a Lot. Subject to all applicable laws, any liability of THA shall be limited to a refund or credit of the charge made for services provided by T.H.A. Nationwide.

All vehicles are sold as unregistered unless expressly stated to the contrary. 

Any deficiency in the goods sold shall not vitiate the sale, but neither the Vendors nor T.H.A  Nationwide shall be bound to deliver more than is in their possession.

 CANCELLATION DUE TO ERROR

You accept that despite our reasonable precautions, goods may be listed at an incorrect price or with incorrect information due to typographical or other errors. 

T.H.A Nationwide reserve the right to cancel any purchase transaction, even if you have paid the purchase price for the goods.

We reserve this right up until the time you collect the goods. If we exercise this right, we will refund to you any purchase price that you have paid.

 USER WARRANTY & INDEMNITY

The user warrants that the computer system used to view and place bids at T.H.A Nationwide online tender and auction is capable of interacting with the facility.  T.H.A Nationwide takes no responsibility and is not  liable for any damage to the user's computer system.
